Yesterday, Huda Beauty has achieved a significant legal victory in India, securing a permanent injunction from the District Commercial Court in New Delhi against Vision Enterprises. The case centered on the importation of counterfeit cosmetics into India by Vision Enterprises, intercepted at Kolkata Port by Customs officials. Upon verification, it was confirmed that these products were indeed counterfeit replicas of Huda Beauty’s offerings.
The court ruling is comprehensive, mandating the seizure and subsequent destruction of the intercepted counterfeit goods. It underscores the severity of trademark infringement, prohibiting Vision Enterprises from further importation, sale, or advertisement of products bearing marks resembling Huda Beauty’s registered trademarks. This injunction aligns with India’s Intellectual Property Rights (Imported Goods) Enforcement Rules, 2007, directing Customs to ensure the destruction of counterfeit items.
Throughout the legal proceedings, Huda Beauty provided robust evidence of its trademark registrations, extensive global presence, and partnerships with prominent retailers in India such as Nykaa and Sephora. The defendant, Vision Enterprises, did not contest the allegations, leading to a decisive ruling in favor of Huda Beauty.
