Yesterday (November 8), The U.S. Food and Drug Administration (FDA) has announced a delay in the enforcement of requirements related to cosmetic product facility registration and product listing under the Modernization of Cosmetics Regulation Act of 2022 (MoCRA). This decision grants an additional six months for the industry to submit the necessary information, extending the deadline from December 29, 2023, to July 1, 2024.
Additionally, the FDA has stated that it will not enforce the registration requirement for owners or operators of facilities that began manufacturing or processing cosmetic products after December 29, 2022. Similarly, the listing requirement for cosmetic products first introduced to the market after the same date will also not be enforced until the July 1, 2024 deadline.
In light of the recent delay in the MoCRA submission portal, the FDA has assured that it will be prepared to accept registration and listing information by the original December 29, 2023, statutory deadline. The agency encourages companies to submit their information by this deadline if they are able to do so.
